
These Terms & Conditions (“Terms”) govern your access to and use of the websites operated by DocketDoc d/b/a DocketDoc (“DocketDoc,” “we,” “us,” or “our”), including any related subdomains, landing pages, applications, surveys, or services (collectively, the “Sites”), as well as the medical evaluation and administrative services we provide (“Client Services”).
By accessing or using the Sites or Client Services, you agree to be bound by these Terms. If you do not agree, you should not use the Sites or Client Services.
DocketDoc provides medical case evaluation, record organization, and administrative support services to individuals seeking clarity regarding potential claims arising from medical care.
DocketDoc:
Is not a law firm
Does not provide legal advice
Does not represent clients in legal matters
Does not act as an attorney, law firm, or legal agent
All services are medical, administrative, and educational in nature.
If a physician affirmation, certificate of merit, or similar certification is required by applicable law prior to commencement of a lawsuit, DocketDoc shall coordinate review by one or more qualified physicians affiliated with DocketDoc or retained by DocketDoc for such purpose. No specific physician is guaranteed to provide such certification. DocketDoc maintains a network of qualified medical professionals and may utilize any appropriate physician based on specialty, availability, and case requirements.
Nothing on the Sites or provided through Client Services constitutes legal advice. Any legal rights, remedies, or strategies must be discussed with a licensed attorney of your choosing.
No attorney-client relationship is created between you and DocketDoc.
Upon request, DocketDoc may provide information about one or more independent attorneys or law firms who may be willing to evaluate your matter.
Important disclosures:
Attorneys operate independently of DocketDoc
DocketDoc does not control or influence legal strategy, representation, or outcomes
DocketDoc does not guarantee that any attorney will accept or pursue your case
Certain physicians affiliated with DocketDoc may hold ownership or financial interests in one or more law firms that may be identified as potential legal resources. Such relationships are disclosed solely for transparency.
You acknowledge that:
You are not required to retain any attorney identified by DocketDoc
You are free to select any attorney of your choosing
Your decision regarding legal representation does not affect the availability or pricing of DocketDoc’s services
The total fee for DocketDoc’s medical evaluation, organization, and consulting services is Fifteen Thousand Dollars ($15,000) (the “Base Fee”).
Client shall pay no fees out of pocket. All fees owed to DocketDoc are payable solely from settlement proceeds or other recovery obtained in connection with the Client’s claim.
Upon a licensed attorney’s written commitment to commence a lawsuit on Client’s behalf, a non-recourse advance in the amount of $2,500 shall be provided by an independent third-party funding source and paid directly to DocketDoc on Client’s behalf. Such advance is non-recourse to Client and is repayable only from a successful settlement, judgment, or recovery. If no recovery is obtained, Client shall owe nothing further and shall have no personal repayment obligation.
The remaining balance of $12,500 shall be payable only from settlement proceeds or other recovery obtained in connection with Client’s claim. If no recovery is obtained, no additional payment shall be owed.
All fees under this Agreement compensate DocketDoc solely for medical, administrative, and consulting services. DocketDoc does not receive a legal contingency fee and does not participate in any attorney fee recovery.
By providing your contact information and using the Sites or Client Services, you agree that DocketDoc may communicate with you via:
Telephone calls
Text messages (SMS)
Where required, DocketDoc will obtain your express written consent at the point of data collection. Communications may include marketing or service-related messages and may be sent using an automatic telephone dialing system or prerecorded or artificial voice, as permitted by law.
Consent is not a condition of purchase.
SMS Messaging Terms:
By opting into our SMS messaging program, you agree to receive text messages related to your interactions with DocketDoc, including appointment reminders, updates, and service-related communications.
To stop receiving messages, reply STOP to any text message. After opting out, you will no longer receive SMS communications unless you opt back in.
Message and data rates may apply. Check with your carrier for details.
Carriers are not liable for delayed or undelivered messages.
By participating in this SMS program, you represent and warrant that you are 18 years of age or older, or have the consent of a parent or legal guardian.
You acknowledge that:
DocketDoc may share your information with third-party marketing partners or service providers, consistent with your consent and applicable law
Such third parties may contact you directly
DocketDoc is not responsible for the actions or services of third-party partners
All third-party relationships are governed by their own terms and policies.
DocketDoc makes no guarantees regarding:
Acceptance of your matter by any attorney
Legal outcomes
Settlement amounts
Duration of any legal process
All services are provided on a best-efforts basis.
DocketDoc handles personal and medical information in accordance with its Privacy Policy, which is incorporated by reference into these Terms.
You agree to:
Provide accurate and truthful information
Authorize the release of medical records where applicable
Use the Sites and Client Services only for lawful purposes
You agree not to misuse the Sites or interfere with their operation.
To the maximum extent permitted by law:
DocketDoc shall not be liable for indirect, incidental, consequential, or punitive damages
DocketDoc’s total liability shall not exceed the amount paid by you to DocketDoc
You agree to indemnify and hold harmless DocketDoc from any claims arising from:
Your misuse of the Sites or Client Services
False or misleading information you provide
Violation of these Terms
Any dispute arising out of or relating to these Terms or the Client Services shall be resolved through binding arbitration administered by JAMS, in accordance with its applicable rules. Judgment on the award may be entered in any court of competent jurisdiction.
These Terms shall be governed by and construed in accordance with the laws of the State of AL, AK, AZ, AR, CA, CO, CT, DE, FL, GA, HI, ID, IL, IN, IA, KS, KY, LA, ME, MD, MA, MI, MN, MS, MO, MT, NE, NV, NH, NJ, NM, NY, NC, ND, OH, OK, OR, PA, RI, SC, SD, TN, TX, UT, VT, VA, WA, WV, WI, WY without regard to conflict-of-law principles.
DocketDoc may update these Terms from time to time. Updates will be posted on the Sites with a revised effective date. Continued use of the Sites or Client Services constitutes acceptance of the updated Terms.
